This is an Online-Only Multi-Tract Auction conducted by The
O’Connor Agency (hereinafter “Auctioneer”). By registering and placing a bid,
all bidders acknowledge they have read and agree to be bound by these Terms and
Conditions, the Offer to Purchase and Acceptance, and any related disclosures,
supplements, and exhibits.
Bidding Opens: October 29th, 2025, at 10:00 AM
Bidding Closes (Soft Close): November 12th, 2025, at 10:00 AM (see Soft Close
procedure in Section 2)
Closing Date: On or before December 17th, 2025, at 5:00 PM
Buyer’s Premium: None
Successful Bidders: The highest bidder(s) on each tract at the close of the
auction will be declared the successful bidder(s), subject to Seller
confirmation.
All bidders must be properly registered and approved prior

Auctioneer reserves the right to request additional registration requirements,
including proof of funds, from bidders unknown to the Seller or Auctioneer.
Bids are subject to Seller’s approval.
Bidders are responsible for maintaining adequate internet service. Auctioneer
and Seller are not liable for service disruptions.
Registration Requirements:
- Bidders will be required to register and sign these Terms and Conditions
before bidding in the auction.
- Bidders are encouraged to register at least 24 hours prior to the bid closing
date. Late registrations may not be approved for bidding.
- Anyone not known by the Auction Company or Sellers may be required to provide
a Bank Letter of Credit, Proof of Funds, or other documentation demonstrating
the ability to purchase, at the discretion of Auction Company or Sellers.
Soft Close Procedure: If a bid is placed with fewer than 5 minutes remaining,
the countdown will automatically reset to 5 minutes for all five tracts, and
bidding will remain open until no further bids are placed.
Property will be offered in Tracts 1–5 as outlined below
(acreages pending preliminary survey):
- Tract 1: 46 acres m/l
- Tract 2: 54 acres m/l
- Tract 3: 130 acres m/l
- Tract 4: 110 acres m/l
- Tract 5: 145 acres m/l
All acreages are estimates. Preliminary survey numbers are pending and will be
updated once received. Final staked survey to govern (if applicable).
No existing farming or hunting leases. Farm is open for the 2026 farming
season.
Bidding will be conducted on a per-acre basis with the
following increments:
- Starting at $0: increments of $500 per acre
- Starting at $5,000: increments of $250 per acre
- Starting at $7,000: increments of $100 per acre- Starting at $9,000: increments of $50 per acre
If adjoining tracts sell to different buyers, Seller will
provide and pay for a staked survey.
If the same bidder wins adjoining tracts, surveys will be provided only as
needed for perimeter boundaries.
If the same bidder wins Tracts 1, 2, and 3, no survey will be provided and the
final price shall be based on combined total acres marketed of those three
tracts.
Tracts 4 and 5 will receive a staked survey regardless of whether they sell
together or separately.
Acres are deemed “more or less” unless surveyed.
Final contract price will be based on winning bid × surveyed acreage (if
applicable).
- The successful high bidder, upon completion of the Real
Estate Auction, must complete and sign a purchase agreement, along with any
Seller disclosures provided.
- United Country – The O’Connor Agency must receive a signed copy of the
contract (hand delivered, faxed, scanned and emailed, or electronically signed)
within 24 hours after the buyer has been notified that the Sellers have
accepted his or her bid.
- Winning bidder(s) must render (within 2 days) a non-refundable deposit of 10%
of the purchase price in the form of a personal check, business check,
certified funds, or wire payable to the designated Closing Company. Balance is
due at final closing.
- Out-of-area personal checks must be approved by Auction Company personnel.
- Sales are non-contingent; failure to close will result in forfeiture of
earnest money.
- Buyer must secure financing approval prior to the auction.
Seller will provide and pay for an Owner’s Title Policy. Buyers will be given an opportunity to review Commitment and satisfy themselves prior to closing.
Seller will be responsible for payment of 2025 real estate taxes.
By bidding, bidders enter into a binding contract.
The Sellers shall have the right to
accept or reject any and all bids. Once accepted, this agreement shall be
binding on the parties and their successors and assigns.
This agreement is not subject to financing, inspections, contingencies, or
delays related to such conditions.
Defaulting buyers may forfeit earnest money and face civil and/or criminal
action.
Registered bidders are personally and financially responsible for bids placed,
whether on their own behalf or as an agent.
Maps, photos, acreages, and tract sizes are approximate.
Tillable acres, if referenced, are estimates based on Auctioneer’s mapping
software.
Buyers are strongly encouraged to perform their own due diligence and verify
all information to their satisfaction. Property is being sold AS-IS, WHERE-IS,
with no warranties expressed or implied.
Seller reserves right to remove personal property to include, but not limited to, any equipment, windmill, and horse equipment prior to close. Any personal property remaining at time of sale shall convey to new owners.
Auctioneer and Seller assume no liability for accuracy of materials provided.
Auctioneer is not responsible for errors, omissions, or internet failures.
